New on TikTok: تجديد تصريح الإقامة للعمل: تجاهل أربع استدعاءات يؤدي إلى رفض التجديد مرحبًا بكم في حلقة جديدة من بودكاست قانون الهجرة. أنا المحامي فابيو لوسكيربو. نتناول اليوم تجديد تصريح الإقامة للعمل من خلال حكم مهم صادر عن المحكمة الإدارية الإقليمية في إيميليا رومانيا، نُشر في 10 يوليو/تموز 2026، في الدعوى المقيدة برقم السجل العام 820 لسنة 2026. تتعلق القضية بمواطن مغربي تقدّم بطلب لتجديد تصريح إقامته للعمل. وبعد تقديم الطلب، استدعته مديرية شرطة بولونيا لاستكمال إجراءات التحقق من الهوية وأخذ البصمات. إلا أنه، رغم استلامه جميع الاستدعاءات بصورة صحيحة، لم يحضر أيًا من أربع مواعيد حددتها الإدارة. وبناءً على ذلك، قررت مديرية الشرطة حفظ الطلب، معتبرة أن الإجراءات الإدارية لا يمكن أن تظل مفتوحة إلى أجل غير محدد في ظل غياب تعاون مقدم الطلب. وقد طعن صاحب الشأن في القرار، مدعيًا أن الإجراء كان غير متناسب، وأن الإدارة كان بإمكانها تحديد موعد جديد، كما كان ينبغي إخطارُه مسبقًا قبل حفظ الملف. إلا أن المحكمة رفضت الطعن. وأكد القضاة أن الإدارة قامت بكل ما يلزم، إذ وجهت إلى مقدم الطلب أربع استدعاءات منفصلة. كما أنه لم ينكر استلامها، ولم يقدم أي مبرر أو دليل على وجود قوة قاهرة أو سبب مشروع يفسر غيابه المتكرر. ويؤكد الحكم أيضًا مبدأً قانونيًا مهمًا، وهو أن العلاقة بين الأفراد والإدارة العامة يجب أن تقوم على حسن النية والتعاون المتبادل. وينطبق هذا المبدأ أيضًا على الأجانب الذين يطلبون أو يجددون تصاريح الإقامة. فمن يقدم طلبًا للإدارة ملزم بالتعاون معها واستكمال جميع الإجراءات اللازمة حتى تتمكن من إنهاء الملف بصورة صحيحة. ولهذا السبب، اعتبرت المحكمة أن قرار حفظ الطلب كان مشروعًا، مؤكدة أن الإدارة ليست ملزمة بتأجيل الإجراءات إلى ما لا نهاية عندما يتخلف مقدم الطلب، دون أي مبرر مقبول، عن حضور المواعيد الرسمية بشكل متكرر. ويُعد هذا الحكم تذكيرًا مهمًا لكل الأجانب المقيمين في إيطاليا بأن الاستدعاءات الصادرة عن مديرية الشرطة ليست مجرد إجراءات شكلية، بل تمثل مرحلة أساسية في إجراءات تجديد تصريح الإقامة، وأن تجاهلها قد يؤدي إلى رفض الطلب بصورة نهائية. شكرًا لكم على الاستماع إلى هذه الحلقة من بودكاست قانون الهجرة. أنا المحامي فابيو لوسكيربو، وألقاكم في الحلقة القادمة لمناقشة أحدث الأحكام القضائية والتطورات التشريعية وأهم قضايا قانون الهجرة في إيطاليا.

Italian Administrative Court: Criminal Convictions Do Not Automatically Bar Residence Permit Renewal

A recent judgment of the Regional Administrative Court for Emilia-Romagna reinforces an increasingly important principle in Italian immigration law: a criminal conviction cannot automatically justify the refusal to renew a residence permit when the applicant has established genuine family ties in Italy. In its judgment issued on 9 June 2026 and published on 20 June 2026, the court reaffirmed that immigration authorities must assess each case individually rather than relying on automatic legal consequences.

The case involved a Nigerian national whose application to renew his residence permit was rejected by the Bologna Police Headquarters because of a previous conviction for a drug-related offence. The authorities considered the conviction sufficient, in itself, to deny the renewal of his residence permit despite the applicant's family and social circumstances.

The Regional Administrative Court disagreed.

According to the judges, Italian immigration law cannot be interpreted as allowing automatic refusals whenever one of the criminal offences listed in the Immigration Act is involved. Instead, where a foreign national has genuine family ties in Italy, the administration has a legal obligation to conduct an individual assessment balancing public security concerns against the applicant's right to family life.

The applicant had informed the authorities that he lived permanently with his partner and daughter in Italy and that he was engaged in regular employment. These elements had already been presented during the administrative proceedings. Nevertheless, the Police Headquarters dismissed the observations with a brief statement that they did not justify reconsidering the application, without explaining why the applicant's family circumstances were insufficient to outweigh the criminal conviction.

The court held that such reasoning failed to satisfy the legal requirements governing immigration decisions.

Referring to the case law of the Italian Constitutional Court and the Council of State, the judgment recalls that the protection of public order must always be balanced against the right to family life guaranteed by Article 8 of the European Convention on Human Rights. Administrative authorities are therefore required to examine the applicant's personal circumstances, including the effectiveness of family relationships, the duration of lawful residence in Italy, the degree of social and professional integration and the individual's ties with the country of origin.

One of the most significant aspects of the decision is its rejection of administrative automatism. The court makes clear that criminal convictions remain highly relevant in immigration proceedings, but they do not relieve the administration of its obligation to provide a genuine assessment supported by adequate reasoning. Immigration authorities cannot simply reproduce statutory provisions or rely on standard formulas without demonstrating that they have actually evaluated the applicant's individual situation.

The judgment also confirms a broader trend within European immigration law. Over the past decade, both European and Italian courts have increasingly required immigration decisions to be based on proportionality and individual assessment rather than rigid legal presumptions. The Emilia-Romagna ruling fits squarely within this evolving jurisprudence by reaffirming that fundamental rights continue to play a decisive role even where public security concerns are involved.

The Regional Administrative Court ultimately annulled the refusal decision and ordered the administration to reconsider the application in accordance with these legal principles.

The decision is likely to have practical consequences extending well beyond the individual case. It serves as a reminder that residence permit decisions cannot be reduced to mechanical administrative procedures. Each application must be examined on its own merits, ensuring that public security objectives are pursued through decisions that are proportionate, adequately reasoned and fully respectful of fundamental rights.

Soy el abogado Fabio Loscerbo. Hoy hablamos de la renovación del permiso de residencia por trabajo por cuenta ajena, analizando una importante sentencia del Tribunal Administrativo Regional de Emilia-Romaña, publicada el 10 de julio de 2026, dictada en el procedimiento inscrito con número de registro general 820 del año 2026. El caso se refiere a un ciudadano marroquí que había solicitado la renovación de su permiso de residencia por trabajo. Tras presentar la solicitud, la Jefatura de Policía de Bolonia lo convocó para completar el procedimiento de identificación y la toma de huellas dactilares. Sin embargo, a pesar de haber recibido correctamente todas las notificaciones, no acudió a ninguna de las cuatro convocatorias realizadas por la Administración. Ante esta situación, la Jefatura de Policía archivó la solicitud al considerar que el procedimiento administrativo no podía permanecer abierto indefinidamente sin la colaboración del interesado. El solicitante impugnó la decisión alegando que la medida era desproporcionada, que podía haberse fijado una nueva cita y que la Administración debía haberle enviado una comunicación previa antes de archivar el expediente. El Tribunal desestimó el recurso. Según los jueces, la Administración ya había actuado con la máxima diligencia al convocar al solicitante en cuatro ocasiones diferentes. Además, el interesado nunca negó haber recibido las citaciones ni aportó ninguna justificación o prueba de fuerza mayor que explicara sus reiteradas ausencias. La sentencia también recuerda un principio fundamental del Derecho administrativo: las relaciones entre los ciudadanos y la Administración deben basarse en la buena fe, la colaboración y el respeto mutuo. Este principio también se aplica a los ciudadanos extranjeros que solicitan o renuevan un permiso de residencia. Quien presenta una solicitud tiene el deber de colaborar con la Administración y de cumplir los trámites necesarios para que el procedimiento pueda concluir correctamente. Por esta razón, el Tribunal consideró plenamente legítimo el archivo de la solicitud, afirmando que la Administración no puede verse obligada a aplazar indefinidamente un procedimiento cuando el solicitante, sin ninguna justificación válida, deja de acudir repetidamente a las convocatorias oficiales. Esta decisión recuerda a todos los ciudadanos extranjeros un aspecto esencial: las convocatorias de la Jefatura de Policía no son un simple trámite administrativo. Constituyen una fase indispensable del procedimiento de renovación del permiso de residencia y su incumplimiento puede conducir al rechazo definitivo de la solicitud. Abstract

La sentenza del Tribunale Amministrativo Regionale per la Puglia, Sezione Terza, pubblicata il 9 giugno 2026 nel procedimento numero di ruolo generale 648 del 2026, affronta una questione di particolare interesse nel diritto dell’immigrazione: le conseguenze del ritardo dell’amministrazione nel procedimento di rilascio del permesso di soggiorno per lavoro stagionale. Il provvedimento si segnala per avere affermato che il mancato rilascio tempestivo del titolo di soggiorno non può trasformarsi in un elemento ostativo alla successiva tutela della posizione giuridica dello straniero. La decisione offre l’occasione per una riflessione sul rapporto tra legalità dell’azione amministrativa, tutela dell’affidamento e garanzie riconosciute ai lavoratori stranieri nell’ambito delle procedure di ingresso per lavoro stagionale.

La vicenda esaminata dal TAR trae origine dall’ingresso regolare in Italia di un cittadino straniero sulla base di un nulla osta al lavoro subordinato stagionale e del conseguente visto di ingresso. Dopo l’arrivo sul territorio nazionale, il lavoratore aveva sottoscritto il contratto di soggiorno e presentato regolare domanda di rilascio del permesso di soggiorno per lavoro stagionale.

L’elemento centrale della controversia è rappresentato dal comportamento dell’amministrazione. La domanda, infatti, rimaneva sostanzialmente inevasa per circa diciotto mesi. Soltanto nel luglio 2025 la Questura adottava un provvedimento di diniego, motivato sul presupposto che il periodo massimo di soggiorno stagionale fosse ormai decorso e che il richiedente non avesse presentato domanda di conversione del titolo di soggiorno.

Il ragionamento seguito dall’amministrazione presenta una evidente contraddizione logica. Da un lato viene contestata la mancata conversione del permesso di soggiorno; dall’altro si omette di considerare che il titolo di soggiorno non era mai stato materialmente rilasciato. La situazione determinata dall’inerzia amministrativa viene così utilizzata come fondamento del successivo provvedimento negativo.

Il TAR Puglia individua proprio in tale profilo il principale vizio dell’azione amministrativa. La sentenza osserva come il superamento del periodo massimo di soggiorno e la mancata richiesta di conversione costituiscano conseguenze direttamente riconducibili al ritardo dell’amministrazione. Ne deriva che tali circostanze non possono essere poste a carico del lavoratore straniero né possono essere utilizzate per giustificare il diniego del titolo richiesto.

Particolarmente significativa appare la distinzione operata dal giudice tra esistenza del diritto e durata temporale degli effetti del titolo di soggiorno. Secondo la ricostruzione accolta dal TAR, il ricorrente possedeva tutti i requisiti richiesti dalla normativa per ottenere il permesso di soggiorno stagionale al momento della presentazione della domanda. L’inerzia amministrativa non è dunque idonea a cancellare retroattivamente una situazione giuridica già perfezionata.

La pronuncia si inserisce nel più ampio filone giurisprudenziale che attribuisce rilievo al principio secondo cui l’amministrazione non può trarre vantaggio dalla propria inattività. Si tratta di un principio che trova fondamento non soltanto nelle regole generali sul procedimento amministrativo, ma anche nei canoni costituzionali di buon andamento, imparzialità e ragionevolezza dell’azione pubblica.

Sotto il profilo sistematico, la decisione assume particolare interesse in quanto riconosce la necessità di una tutela sostanziale della posizione dello straniero. Il TAR afferma infatti che l’amministrazione avrebbe dovuto procedere al rilascio del permesso di soggiorno richiesto, riconoscendo l’esistenza del diritto maturato al momento della presentazione dell’istanza. In questo modo il giudice separa il tema della spettanza del titolo da quello della sua efficacia temporale, evitando che il decorso del tempo provocato dall’inerzia amministrativa si traduca in una definitiva perdita di tutela.

Di rilievo appare anche il passaggio motivazionale con il quale il tribunale respinge le argomentazioni difensive fondate sulle presunte limitazioni tecniche dei sistemi informatici utilizzati dall’amministrazione. La sentenza ribadisce che eventuali difficoltà organizzative o informatiche non possono comprimere diritti soggettivi o interessi legittimi riconosciuti dall’ordinamento. L’obbligo di conformarsi alla decisione giurisdizionale impone all’amministrazione di individuare gli strumenti tecnici più idonei per garantire una corretta esecuzione del giudicato.

La decisione presenta inoltre implicazioni che vanno oltre il caso concreto. Nel sistema dell’immigrazione, il possesso di un determinato titolo di soggiorno costituisce spesso il presupposto per l’accesso a ulteriori procedure amministrative, tra cui il rinnovo o la conversione del permesso stesso. L’assenza del titolo, quando dipende esclusivamente dall’inerzia dell’amministrazione, rischia quindi di produrre effetti pregiudizievoli a catena. La sentenza del TAR Puglia interviene proprio per interrompere tale meccanismo, riaffermando che il mancato rispetto dei tempi procedimentali non può tradursi in una perdita definitiva delle opportunità riconosciute dalla legge.

La pronuncia conferma, in definitiva, che il procedimento amministrativo in materia di immigrazione non può essere interpretato come una sequenza meramente formale di adempimenti burocratici. Esso costituisce invece lo strumento attraverso il quale vengono concretamente garantiti diritti e posizioni giuridiche riconosciute dall’ordinamento. Quando l’amministrazione omette di esercitare tempestivamente le proprie funzioni, le conseguenze dell’inerzia devono ricadere sull’apparato pubblico e non sul cittadino straniero che abbia correttamente adempiuto ai propri obblighi.

أصدرت المحكمة الإدارية الإقليمية في لاتسيو حكمًا مهمًا قد يؤثر في طريقة تعامل السلطات الإيطالية مع طلبات التأشيرة المرتبطة بالإشارات المسجلة في نظام معلومات شنغن (SIS). ففي الحكم المنشور بتاريخ 9 يونيو 2026، أكدت المحكمة أن مجرد وجود إشارة في نظام معلومات شنغن لا يكفي، بمفرده، لتبرير رفض منح تأشيرة دخول، ما لم يتم إبلاغ مقدم الطلب بالأسباب المحددة التي أدت إلى هذا الرفض.

وتتعلق القضية بمواطن أجنبي تقدم بطلب للحصول على تأشيرة عمل لدى القنصلية الإيطالية في الدار البيضاء. وقد رُفض طلبه بسبب إشارة كانت السلطات النمساوية قد أدرجتها في نظام معلومات شنغن. إلا أن النمسا قامت لاحقًا بحذف هذه الإشارة، ومع ذلك رفضت القنصلية الإيطالية إعادة النظر في الطلب، مبررة موقفها بوجود عوائق إجرائية وتقنية.

غير أن المحكمة الإدارية لم توافق على هذا الموقف.

واستنادًا إلى اجتهادات محكمة العدل التابعة للاتحاد الأوروبي، أكدت المحكمة أن الدولة العضو التي ترفض منح التأشيرة بسبب اعتراض صادر عن دولة عضو أخرى ملزمة بإبلاغ مقدم الطلب ليس فقط بوجود هذا الاعتراض، وإنما أيضًا باسم الدولة التي أصدرته وبالسبب المحدد الذي استندت إليه. فبدون هذه المعلومات، يصبح من المستحيل على الشخص المعني ممارسة حقه في الدفاع والطعن في القرار بصورة فعالة.

وتكتسب هذه القضية أهمية خاصة لأنها توسع نطاق هذه الضمانات الإجرائية لتشمل أيضًا التأشيرات الوطنية الخاصة بالعمل، وليس فقط تأشيرات شنغن قصيرة الإقامة. وترى المحكمة أنه لا يوجد أي أساس قانوني يبرر منح مستوى أقل من الحماية الإجرائية لمجرد أن الطلب يتعلق بتأشيرة وطنية.

كما استندت المحكمة إلى حكم حديث صادر عن المحكمة الدستورية الإيطالية، أكدت فيه أن التشريع الأوروبي الحالي المنظم لنظام معلومات شنغن لا يمنح الإشارة المسجلة في النظام أثرًا مانعًا بصورة تلقائية. بل تظل السلطات الوطنية ملزمة بإجراء تقييم فردي لكل حالة، للتحقق مما إذا كان الشخص يشكل بالفعل تهديدًا حقيقيًا للنظام العام أو للأمن العام.

ويمثل هذا الجانب أهم ما جاء في الحكم، إذ يضع حدًا لممارسة إدارية استمرت لسنوات، كانت تعتبر الإشارة في نظام معلومات شنغن سببًا شبه تلقائي لرفض التأشيرات أو تصاريح الإقامة. وتؤكد المحكمة أن قواعد البيانات الأوروبية هي أدوات للتعاون الإداري، وليست بديلًا عن السلطة التقديرية للإدارة أو عن واجبها في دراسة كل حالة على حدة.

كما انتقدت المحكمة السلطات الإيطالية لأنها لم تُجرِ أي تحقيق فعلي بعد حذف الإشارة من قبل السلطات النمساوية. فلم تتواصل مع الجهات النمساوية للحصول على معلومات إضافية، ولم تُعد تقييم وضع مقدم الطلب، بل اكتفت بالاعتماد على البيانات الظاهرة في النظام الإلكتروني المستخدم لإدارة طلبات التأشيرة.

وبإبطالها قرار رفض التأشيرة، أعادت المحكمة التأكيد على مبدأ أساسي في قانون الهجرة الأوروبي، وهو أن الأنظمة الرقمية تسهّل التعاون بين الدول، لكنها لا يمكن أن تحل محل واجب الإدارة في تسبيب قراراتها، ودراسة الظروف الفردية لكل حالة، وضمان الحق في اللجوء إلى القضاء بصورة فعالة.

وفي ظل الاعتماد المتزايد للسياسات الأوروبية الخاصة بالهجرة على قواعد البيانات المشتركة وأنظمة تبادل المعلومات، يذكر هذا الحكم بأن الكفاءة التكنولوجية لا يمكن أن تكون على حساب الضمانات الأساسية التي يقوم عليها مبدأ سيادة القانون.

Bologna Court Confirms Special Protection Rights Despite Italy’s Cutro Decree

Bologna, Italy – Two important decisions issued by the Bologna Court on May 22, 2026, have reaffirmed that foreign nationals who have built a genuine life in Italy may still qualify for special protection residence permits, even after the restrictive reforms introduced by the so-called Cutro Decree.

The rulings concerned two Moroccan nationals whose applications for international protection had been rejected by the Territorial Commission. After reviewing the cases, however, the Court concluded that both applicants had developed strong social, economic, and personal ties in Italy that made their removal incompatible with the protection of fundamental rights.

The decisions are particularly significant because they rely heavily on a recent ruling of the Italian Supreme Court, decision no. 13309 of November 11, 2025. In that landmark judgment, the Supreme Court clarified that the 2023 reforms did not eliminate the protection of private and family life guaranteed under Article 8 of the European Convention on Human Rights.

According to the Bologna Court, the legal framework introduced by the Cutro Decree must still be interpreted in light of Italy’s constitutional and international obligations. As a result, immigration authorities and courts remain required to assess whether a person's removal would disproportionately interfere with the private and family life established in Italy.

In the first case, the Court highlighted the applicant’s continuous employment in the construction sector, his independent housing arrangement, and the fact that he had obtained an Italian driving licence. In the second case, judges emphasized a permanent employment contract, participation in Italian language courses, stable accommodation, and the absence of any criminal record.

The Court stressed that integration cannot be measured solely through employment. Instead, judges must evaluate the overall reality of a person’s life in Italy, including social relationships, economic independence, community involvement, and respect for the rules of the host country.

By recognizing the applicants’ right to special protection residence permits, the Bologna Court confirmed that integration remains a key factor in Italian immigration law, despite legislative efforts to narrow the scope of humanitarian-based protections.

The decisions are expected to influence many pending cases throughout Italy, particularly those involving foreign nationals who have developed strong ties to Italian society while awaiting the outcome of immigration proceedings.

As Italian courts continue to interpret the post-Cutro legal framework, these rulings suggest that constitutional principles and human rights obligations will remain central to the assessment of special protection claims.

New on TikTok: SIS Alert: When Can It Prevent the Issuance of a Residence Permit? Welcome to a new episode of the Immigration Law podcast. I am Attorney Fabio Loscerbo. Today we are discussing the legal effects of a Schengen Information System, or SIS, alert on the issuance of an Italian residence permit, by examining an important judgment of the Regional Administrative Court for Emilia-Romagna, published on 1 July 2026, issued in General Register case number 813 of 2022. The case concerned a foreign national who had applied for regularization under Italy's undeclared work legalization procedure. However, the Police Headquarters of Modena rejected the application because the applicant was the subject of a Schengen Information System alert, entered by the French authorities for the purpose of refusing admission into the Schengen Area. The applicant argued that the Italian authorities should have assessed his personal circumstances instead of automatically relying on the alert issued by another Member State. The Court rejected the appeal and reaffirmed an important legal principle. According to the judges, an SIS alert issued for the purpose of refusing entry generally constitutes a legal obstacle to the issuance of a residence permit. For that reason, the Police Headquarters' decision is considered a mandatory administrative act. The authorities are not required to carry out an independent assessment of the applicant's personal dangerousness, nor are they expected to review the legality or correctness of the alert entered by the foreign State. The judgment also highlights an important exception under European law. A Member State may still decide to issue a residence permit despite the existence of an SIS alert, but only in the presence of serious grounds, particularly humanitarian reasons or obligations arising under international law. In such cases, the State intending to issue the permit must first consult the Member State that entered the SIS alert. This decision confirms a well-established principle of immigration law: an SIS alert is not merely an administrative record. It produces direct legal consequences and may prevent the issuance of a residence permit in Italy. Only in exceptional situations expressly provided for by law can that obstacle be overcome.
