Aujourd'hui, nous parlons d'une récente décision du Tribunal administratif régional d'Émilie-Romagne, publiée le 4 juin 2026, qui concerne une question très importante pour les travailleurs étrangers entrés en Italie dans le cadre du système des quotas pour le travail saisonnier.
L'affaire concerne deux ressortissants étrangers qui avaient obtenu légalement un visa d'entrée sur la base d'une autorisation de travail délivrée pour un emploi saisonnier dans le secteur agricole. Une fois arrivés en Italie, ils ont cependant découvert que l'employeur qui avait demandé leur recrutement était devenu introuvable et que la relation de travail n'avait jamais commencé.
Les travailleurs ont alors demandé la délivrance d'un titre de séjour pour recherche d'emploi, estimant qu'ils ne devaient pas être pénalisés pour une situation indépendante de leur volonté.
La demande a été rejetée par l'administration et le Tribunal administratif a confirmé cette décision.
Selon les juges, le titre de séjour pour recherche d'emploi ne peut être accordé que lorsqu'une relation de travail a effectivement été établie puis interrompue pour des raisons non imputables au travailleur. Dans cette affaire, le contrat de séjour n'avait jamais été signé et l'activité professionnelle n'avait jamais débuté.
Pour cette raison, le Tribunal a considéré que les conditions prévues par la loi pour obtenir un titre de séjour pour recherche d'emploi n'étaient pas réunies.
Il s'agit d'une décision particulièrement importante, car elle concerne une situation qui n'est pas rare dans la pratique et qui peut toucher de nombreux travailleurs entrés légalement en Italie dans le cadre des quotas pour le travail saisonnier.
Il faudra maintenant voir si la jurisprudence future adoptera une interprétation différente ou si le législateur interviendra pour combler cette lacune de protection.

Protección especial después del Decreto Cutro: el Tribunal de Bolonia confirma la importancia de la integración y de la vida privada

Bienvenidos a un nuevo episodio del pódcast Derecho de Inmigración. Soy el abogado Fabio Loscerbo. Hoy hablaremos de dos importantes resoluciones dictadas por el Tribunal de Bolonia el 22 de mayo de 2026. Estas decisiones confirman un principio que podría tener un impacto significativo en numerosos procedimientos de protección especial que todavía están pendientes en Italia. Los casos se referían a dos ciudadanos marroquíes cuyas solicitudes de protección internacional habían sido rechazadas por la Comisión Territorial. Sin embargo, durante el procedimiento judicial surgió un elemento decisivo: ambos habían construido una vida real en Italia a través de un empleo regular, una vivienda estable, relaciones sociales sólidas y el respeto de las normas del país de acogida. El aspecto más relevante de estas resoluciones es que el Tribunal se apoya expresamente en la decisión número 13309 de 2025 del Tribunal Supremo italiano. Según el Tribunal de Bolonia, el Decreto Cutro no eliminó la protección de la vida privada y familiar de los ciudadanos extranjeros. Incluso después de la reforma de 2023, las obligaciones constitucionales e internacionales siguen exigiendo una evaluación del grado de integración alcanzado por la persona en Italia. Los jueces destacan que cuanto más sólida sea la vida construida en Italia, más grave puede resultar una expulsión o un retorno forzoso. Estas medidas pueden vulnerar el derecho a la vida privada y familiar protegido por el artículo 8 del Convenio Europeo de Derechos Humanos y por los principios fundamentales de la Constitución italiana. La evaluación no se limita al trabajo, sino que abarca todo el proceso de integración social, personal y familiar desarrollado en el país. En el primer caso, el Tribunal valoró varios años de trabajo en el sector de la construcción, la disponibilidad de una vivienda independiente y la obtención del permiso de conducir italiano. En el segundo caso, consideró especialmente relevante la existencia de un contrato de trabajo indefinido, la asistencia a cursos de lengua italiana, una vivienda autónoma y la ausencia de antecedentes penales o comportamientos negativos. A la luz de estos elementos, el Tribunal de Bolonia reconoció a ambos solicitantes el derecho a obtener un permiso de residencia por protección especial con una duración de dos años, renovable y válido para trabajar legalmente en Italia. Estas resoluciones confirman que la integración sigue siendo un elemento fundamental en la evaluación de las solicitudes de protección especial y que el derecho a la vida privada y familiar continúa desempeñando un papel central incluso dentro del marco jurídico posterior al Decreto Cutro. Nulla osta e permesso di soggiorno: cosa succede se cambia il datore di lavoro? Benvenuti a un nuovo episodio del podcast “Diritto dell’Immigrazione”.
Io sono l’avvocato Fabio Loscerbo e oggi parliamo di una recente sentenza del TAR Emilia-Romagna che riguarda la conversione del permesso di soggiorno da tirocinio a lavoro subordinato e, in particolare, il tema del nulla osta. La decisione affronta un problema molto frequente nella pratica: cosa accade quando il lavoratore straniero ottiene il nulla osta per essere assunto da una determinata azienda, ma poi inizia a lavorare con un altro datore di lavoro. Nel caso esaminato dal TAR, il cittadino straniero aveva ottenuto il nulla osta alla conversione del permesso di soggiorno e aveva sottoscritto il contratto di soggiorno con una specifica azienda. Successivamente, però, aveva iniziato un rapporto di lavoro con un diverso datore. La Questura di Forlì ha quindi dichiarato irricevibile la domanda di conversione del permesso di soggiorno per lavoro subordinato. Secondo il TAR, il nulla osta è collegato allo specifico datore di lavoro che ha avviato la procedura amministrativa.
Per questo motivo, almeno nella fase iniziale, deve esserci coerenza tra il datore che richiede il nulla osta, il contratto di soggiorno e l’effettiva assunzione del lavoratore straniero. I giudici spiegano anche che questa interpretazione serve ad evitare utilizzi distorti del sistema, cioè casi in cui vengono avviate procedure senza una reale intenzione di assumere il lavoratore. Ma c’è un aspetto molto importante.
Il TAR sottolinea che il ricorrente non aveva fornito alcuna spiegazione concreta sulle ragioni del mancato avvio del primo rapporto di lavoro. Ed è proprio qui che, spesso, si gioca la strategia difensiva: documentare le ragioni del cambiamento, dimostrare la continuità lavorativa e spiegare in modo preciso cosa è accaduto durante la procedura amministrativa.
