Can a Worker Lose Their Work Authorization Because of the Employer's Mistakes? Welcome to a new episode of the podcast Immigration Law. My name is Fabio Loscerbo, and I am an immigration lawyer. Today we discuss an important decision published on 16 April 2026 by the Regional Administrative Court of Bolzano, Judgment Number 92 of 2026, issued in Case Number 245 of 2025. The case involved a foreign worker who had legally entered Italy through the Italian quota-based immigration system, commonly known as the Decreto Flussi, after obtaining both a visa and a work authorization. Later, however, the administration revoked the work authorization because the employer had failed to submit all the documents required by law. The worker challenged the decision, arguing that he had cooperated with the authorities and had provided all the documents available to him. Nevertheless, the Court rejected the appeal, holding that the documentary obligations imposed by the procedure primarily fall upon the employer. According to the judges, the continued absence of essential documentation justified the revocation of the work authorization. The judgment also addresses the issue of the residence permit for job seeking. The Court explained that this permit may be granted only in exceptional circumstances, such as when the employment relationship cannot be established because of force majeure affecting the employer, including bankruptcy or other extraordinary events. In this case, those conditions were not met. This decision highlights an important aspect of the Italian quota-based immigration system. The legal position of a foreign worker remains closely connected to the employer’s compliance with administrative requirements. As a result, omissions or irregularities attributable to the employer may have serious consequences for a worker who has already entered Italy lawfully.
