Italy: Schengen Alert Blocks Regularisation Application, Court Upholds Refusal
An Italian administrative court has upheld the refusal of an application to regularise undeclared employment because the applicant was listed in the Schengen Information System for the purpose of refusing entry.
In judgment no. 1265 of 1 July 2026, the Regional Administrative Court of Emilia-Romagna rejected an appeal against a decision issued by the Police Headquarters in Modena.
The court held that the Schengen alert constituted a legal obstacle to the regularisation procedure and that the Italian authorities were not required to reassess the applicant’s personal dangerousness or review the legality of the decision adopted by France.
The alert had been entered by France
The case concerned an application submitted under the 2020 Italian regularisation programme for undeclared work.
The Police Headquarters rejected the application after finding that France had entered an alert concerning the applicant in the Schengen Information System on 19 March 2021.
The alert was intended to prevent the person’s admission into the Schengen area and had been confirmed by the competent French authority.
The applicant challenged the refusal, arguing that the alert resulted only from an administrative immigration violation connected to illegal entry into France.
He also claimed that the Italian authorities should have assessed his personal circumstances, the requirements for regularisation and the possible existence of serious reasons justifying the issue of a residence permit.
The court rejected those arguments.
The Schengen alert was considered an automatic legal obstacle
The judges relied on the special rules governing the 2020 regularisation procedure.
Under Article 103 of Decree-Law no. 34 of 2020, foreign nationals listed for non-admission under international agreements binding on Italy were excluded from the regularisation process.
For the court, the alert therefore represented a direct legal obstacle.
Once the authorities had verified the existence and continued validity of the alert, they had no ordinary discretion to approve the application.
The refusal was consequently treated as a mandatory decision rather than the outcome of a broader discretionary assessment.
Italy was not required to reassess the French decision
One of the central issues was whether the Italian authorities had to review the reasons behind the French alert.
The court answered no.
The Schengen system is based on cooperation and mutual trust between participating states. An alert entered by one country produces effects throughout the Schengen area.
The Italian Police Headquarters was therefore not required to determine independently whether the applicant posed a current threat to public order.
Nor was it competent to review whether the French measure had been correct or proportionate.
That assessment primarily belongs to the authorities and courts of the state that entered the alert.
An alert does not always mean criminal dangerousness
The judgment is important because a Schengen alert may arise from different situations.
It does not necessarily mean that the person has been convicted of a crime or represents a serious security threat.
An alert may also result from a return decision, an entry ban or a violation of immigration rules.
In this case, the applicant argued that the alert was linked to illegal entry into France.
The court nevertheless held that the legal effect depended on the type and validity of the alert, not on whether the underlying conduct amounted to a criminal offence.
As long as the alert remained active, the Italian authorities were required to recognise its consequences.
A residence permit may still be issued for serious reasons
The court also explained that the obstacle is not absolute in every circumstance.
A Schengen state may decide to issue a residence permit despite an alert, but only where serious reasons exist, particularly humanitarian reasons or obligations arising under international law.
Such reasons must be concrete and particularly significant.
They may include, depending on the circumstances, protection of family life, the interests of children, serious health conditions or obligations connected to the principle of non-refoulement.
However, the state cannot simply ignore the alert.
It must first consult the country that entered it.
The consultation procedure is intended to balance the foreign state’s decision with any legal obligation requiring another Schengen country to grant residence.
In the case examined by the court, no sufficiently serious reason had been demonstrated.
The authorities did not need to prove current dangerousness
The applicant also complained that the Police Headquarters had failed to assess whether he was currently dangerous.
The court held that such an assessment was unnecessary in this specific regularisation procedure.
The refusal did not depend on an independent finding that the person represented a danger. It depended on the existence of a legal condition expressly excluding access to the programme.
This distinction is significant.
Where the law directly treats a Schengen alert as an exclusion ground, the authorities do not have to reconstruct the applicant’s entire personal history or carry out a new public-order assessment.
The relevant questions are whether the alert exists, whether it is current and whether any exceptional serious reasons justify consultation and a possible derogation.
The applicant must challenge the alert in the correct country
The ruling does not mean that Schengen alerts are beyond legal challenge.
A person who considers an alert inaccurate, outdated or unlawful may request access to the relevant data and seek correction or deletion.
However, the challenge must generally be directed to the competent authorities of the country that entered the alert.
In this case, the applicant would therefore have needed to address the French authorities if he wished to contest the basis or continuing validity of the measure.
The Italian administration could verify the existence of the alert, but could not cancel or rewrite a decision entered by France.
A major practical issue for immigration lawyers
The judgment has important practical consequences.
When a residence or regularisation application is refused because of a Schengen alert, challenging only the Italian decision may not be enough.
The defence should first establish:
which country entered the alert;
the date and legal basis of the measure;
the type of alert;
whether it is still valid;
whether there are grounds for correction or deletion;
whether serious humanitarian or international-law reasons exist.
The legal strategy often has to proceed on two levels.
The alert must be challenged or removed in the state that entered it, while any exceptional grounds supporting a residence permit must be documented before the Italian authorities.
Mutual trust cannot eliminate individual rights
The judgment confirms the strength of the Schengen Information System within European immigration law.
A national authority cannot freely disregard an alert entered by another state. Otherwise, the entire system of shared border control would lose effectiveness.
At the same time, mutual trust cannot turn a digital record into an untouchable fact.
Alerts must remain accurate, current and proportionate. Individuals must have access to effective procedures for checking the data and requesting correction or deletion.
The decision therefore highlights two competing principles.
The first is the need for cooperation between Schengen states. The second is the individual’s right to challenge a measure that may prevent entry, residence or regularisation across much of Europe.
In the case decided by the court, the active French alert prevailed. The Italian authorities were therefore entitled to reject the regularisation application.

Italia revoca la autorización de trabajo tras la desaparición del empleador: el tribunal confirma la decisión
Un tribunal administrativo italiano ha confirmado la revocación de una autorización de trabajo concedida en el marco del sistema de cuotas de entrada, después de que el empleador no completara el procedimiento de contratación y acabara siendo ilocalizable.
Mediante la sentencia n.º 1263, de 1 de julio de 2026, el Tribunal Administrativo Regional de Emilia-Romaña rechazó el recurso presentado por un trabajador extranjero contra la decisión de la Prefectura de Rímini de revocar su autorización de trabajo.
El caso pone de manifiesto una debilidad recurrente del sistema migratorio italiano: un trabajador extranjero puede entrar legalmente en Italia con un visado y una autorización de trabajo válidos y, sin embargo, perder posteriormente la posibilidad de regularizar su residencia porque el empleador no cumple las formalidades exigidas.
El empleador nunca se presentó
El trabajador había entrado en Italia en marzo de 2024 tras obtener una autorización para trabajar por cuenta ajena. De acuerdo con la legislación italiana, el empleador y el trabajador debían firmar el contrato de residencia y transmitirlo a la Oficina Única de Inmigración dentro de los quince días siguientes a la entrada en el territorio nacional.
Ese trámite nunca llegó a completarse.
La Prefectura fijó varias citas para concluir el procedimiento, pero el empleador no se presentó y más tarde se volvió ilocalizable.
Según los hechos recogidos en la sentencia, el mismo empleador habría presentado cuarenta y dos solicitudes de autorización de trabajo, pese a no disponer aparentemente de la capacidad económica ni del volumen de negocio necesarios para sostener un número tan elevado de contrataciones.
El trabajador intentó resolver la situación, también con asistencia letrada, y se le indicó la posibilidad de buscar a otro empleador. Sin embargo, no se formalizó ninguna sustitución dentro del plazo considerado admisible por la Administración.
La Prefectura decidió entonces revocar la autorización inicial.
El tribunal: el procedimiento no puede quedar abierto indefinidamente
El tribunal consideró que la Prefectura había actuado conforme a Derecho.
El artículo 22 del Decreto Legislativo italiano n.º 286 de 1998 establece que la autorización de trabajo puede ser revocada cuando el contrato de residencia no se firma y transmite dentro del plazo legal, salvo que el retraso se deba a fuerza mayor o a circunstancias no imputables al trabajador.
Los jueces reconocieron que el empleador había desaparecido, pero entendieron que el procedimiento administrativo no podía mantenerse abierto sin límite a la espera de que el trabajador encontrara un nuevo empleador.
Según el tribunal, la ausencia definitiva del empleador original impedía completar el procedimiento. La revocación debía considerarse, por tanto, una consecuencia obligatoria y no una decisión discrecional de la Administración.
Una interpretación estricta del sistema de cuotas
La sentencia se sitúa dentro de una línea cada vez más rigurosa de la jurisprudencia administrativa italiana.
Según este enfoque, la revocación de la autorización de trabajo no constituye una medida ordinaria de revisión administrativa. Se considera más bien una forma de pérdida o caducidad del beneficio, derivada de la ausencia o desaparición de los requisitos necesarios para completar el procedimiento de entrada y residencia.
Esta calificación tiene importantes consecuencias. Significa que la Administración no está obligada a reconsiderar toda la situación personal del trabajador, como su grado de integración, sus perspectivas laborales, su buena conducta o la ausencia de antecedentes penales, salvo que esos elementos sean expresamente relevantes conforme a la normativa aplicable.
El tribunal también recordó que la autorización puede ser revocada no solo en casos de fraude o falsificación documental, sino también cuando falten los requisitos sustanciales para la entrada del trabajador. Entre ellos se encuentran la capacidad económica del empleador y la existencia real del puesto de trabajo ofrecido.
El trabajador soporta las consecuencias de la conducta del empleador
El caso plantea, sin embargo, una importante cuestión de equidad.
La ley dispone expresamente que la autorización no debería revocarse cuando la falta de formalización del contrato no sea imputable al trabajador. Sin embargo, en muchos casos el trabajador no tiene ningún control real sobre la conducta del empleador.
Un ciudadano extranjero puede haber obtenido un visado, abandonado su país, afrontado gastos importantes y cumplido todas las exigencias administrativas, para descubrir después que el empleador ya no quiere realizar la contratación o que nunca tuvo capacidad real para hacerlo.
Pese a ello, la respuesta administrativa suele trasladar todas las consecuencias al trabajador.
Existe, por tanto, una contradicción evidente: la Administración autoriza la entrada basándose en una oferta de trabajo, pero si el empleador desaparece después, el trabajador puede quedarse sin una vía legal para permanecer en Italia, incluso cuando haya actuado de buena fe.
La cuestión pendiente de la sustitución del empleador
Otro aspecto central es la posibilidad de sustituir al empleador original.
El tribunal consideró que la Prefectura no estaba obligada a mantener abierto el procedimiento hasta que apareciera un nuevo empleador. En el sistema actual, la autorización de trabajo está normalmente vinculada a un empleador concreto, a una oferta determinada y a una cuota específica.
Sin embargo, el caso demuestra la necesidad de reglas más claras.
Cuando el empleador original desaparece, se vuelve insolvente o se descubre que ha presentado solicitudes poco fiables, el trabajador no debería perder automáticamente toda posibilidad de regularización.
Un procedimiento uniforme que permitiera la sustitución del empleador podría proteger a quienes han entrado legalmente y de buena fe, sin debilitar los controles contra los abusos del sistema de cuotas.
Un problema estructural del sistema italiano
La sentencia pone de relieve una debilidad más profunda: los controles esenciales sobre los empleadores se realizan con frecuencia demasiado tarde.
Cuando la Administración comprueba la capacidad económica y la fiabilidad del empleador solo después de que el trabajador haya entrado en Italia, el riesgo del fracaso administrativo acaba siendo trasladado al extranjero.
El trabajador soporta así las consecuencias de controles previos insuficientes, de prácticas de contratación fraudulentas o de la negativa posterior del empleador a completar el procedimiento.
Unos controles más rigurosos antes de expedir el visado y la autorización de trabajo reducirían este tipo de casos. Al mismo tiempo, la legislación debería garantizar una protección efectiva al trabajador que no es responsable del fracaso de la relación laboral.
La lucha contra las solicitudes fraudulentas es necesaria. Pero no debería conducir a sancionar automáticamente a quienes han entrado legalmente en Italia y han confiado en una oferta de trabajo previamente aprobada por las autoridades públicas.

إيطاليا: محكمة تلغي الإغلاق التلقائي لإجراء متعلق بالعمل الموسمي
ألغت محكمة إدارية إيطالية قرار إغلاق إجراء دخول للعمل الموسمي، بعدما تبيّن أن الإدارة لم تمنح صاحب العمل والعامل فرصة لشرح سبب عدم وصول عقد الإقامة داخل الأجل القانوني.
وبموجب الحكم رقم 1318 الصادر في 10 يوليو/تموز 2026، قررت المحكمة الإدارية الإقليمية في إميليا رومانيا أن المكتب الموحد للهجرة في ريميني لا يجوز له أرشفة الملف تلقائياً لمجرد أن عقد الإقامة الموقّع رقمياً لم يظهر في النظام الوزاري خلال مهلة خمسة عشر يوماً.
ويعزز الحكم الضمانات الإجرائية المقررة للعمال الأجانب المقبولين في إيطاليا ضمن نظام حصص العمالة، كما يؤكد مبدأ أساسياً: القيود التقنية لمنصة إدارية لا يمكن أن تلغي حقوقاً يقررها القانون صراحة.
العامل دخل إيطاليا بصورة قانونية وكان قد بدأ العمل بالفعل
تعلقت القضية بمواطن مصري حصل على ترخيص لدخول إيطاليا للعمل الموسمي في القطاع الفندقي.
وبعد صدور تصريح العمل، منحته السفارة الإيطالية في القاهرة التأشيرة اللازمة. ودخل العامل إيطاليا في 23 مارس/آذار 2026، وأبلغ صاحب العمل بوصوله.
وفي 30 مارس/آذار، وقّع الطرفان عقد الإقامة ورقياً. ثم سلّم صاحب العمل الوثائق إلى منظمة لأصحاب العمل كانت مكلفة بمتابعة بقية الإجراءات المرتبطة بمرسوم تدفقات العمالة الأجنبية.
وفي 1 أبريل/نيسان 2026 جرى توظيف العامل رسمياً.
ومع ذلك، قرر المكتب الموحد للهجرة أرشفة الإجراء في 12 أبريل/نيسان، بحجة أن العقد الموقّع رقمياً لم يُرسل خلال مهلة الخمسة عشر يوماً المنصوص عليها في قانون الهجرة الإيطالي.
ولم يتلقَّ العامل أو صاحب العمل أي إخطار مسبق قبل إغلاق الملف.
المحكمة: الإخطار المسبق كان ضرورياً
ألغت المحكمة قرار الأرشفة.
تنص المادة 22 من المرسوم التشريعي الإيطالي رقم 286 لسنة 1998 على إمكانية رفض تصريح العمل أو إلغائه إذا لم يُرسل عقد الإقامة داخل المهلة المحددة.
غير أن النص نفسه يتضمن استثناء مهماً: فلا تُطبق النتيجة السلبية إذا كان التأخير ناشئاً عن قوة قاهرة أو عن ظروف لا يمكن نسبتها إلى العامل.
وبحسب المحكمة، فإن هذا الاستثناء يغيّر طبيعة الإجراء بصورة جوهرية.
فلا يجوز للإدارة أن تكتفي بفحص ما إذا كان العقد ظاهراً في النظام الإلكتروني، ثم تغلق الملف تلقائياً. بل يجب عليها أولاً إخطار الطرفين بعدم استلام الوثيقة، ومنحهما فرصة لبيان أسباب التأخير.
ومن دون هذا الإخطار، لا تكون لدى العامل إمكانية حقيقية لإثبات أن عدم الإرسال لم يكن ناتجاً عن خطأ منه.
الضمانات الإجرائية ليست مجرد شكليات
منح الحكم قيمة جوهرية لحق المشاركة في الإجراء الإداري.
فالقانون الإداري الإيطالي يفرض، في الأصل، على الإدارة أن تُعلم أصحاب المصلحة قبل اتخاذ قرار قد يضر بطلبهم. ويتيح هذا الإخطار تقديم ملاحظات ووثائق وتوضيحات.
وفي هذه القضية، كان من الممكن للإخطار المسبق أن يسمح للطرفين بإثبات أن العقد وُقّع في الموعد، وأن العامل عُيّن فعلياً، وأن مهمة إرسال الوثائق أُسندت إلى جهة وسيطة.
ولهذا رفضت المحكمة اعتبار غياب الإخطار مجرد مخالفة إجرائية بسيطة.
فالحق في تبرير التأخير يرتبط مباشرة بالاستثناء المنصوص عليه في قانون الهجرة، وبالتالي كان الإخطار ضرورياً لجعل الحماية من التأخيرات غير المنسوبة إلى العامل حماية فعلية وليست نظرية فقط.
النظام المعلوماتي الوزاري لا يعلو على القانون
يتعلق أحد أهم جوانب الحكم بالمنصة الرقمية التي تستخدمها الإدارة.
فقد دفعت المحافظة بأن النظام المعلوماتي الوزاري لا يتضمن آلية للإخطار التلقائي قبل أرشفة الملفات من هذا النوع.
لكن المحكمة اعتبرت هذا الدفع غير ذي قيمة قانونية.
فالبرامج والأنظمة الإدارية يجب أن تتكيف مع القانون، وليس العكس. ولا يجوز تعطيل قاعدة قانونية لمجرد أن النظام الإلكتروني لم يُصمم لإدارة ضمان إجرائي معين.
ولهذا المبدأ دلالة أوسع.
فمع تزايد رقمنة إجراءات الهجرة، يتزايد خطر تحول التقييمات القانونية المعقدة إلى نتائج تقنية جامدة. وقد يؤدي عدم تحميل وثيقة، أو نقص في التوقيع الرقمي، أو خطأ من جهة وسيطة إلى نتائج غير متناسبة.
وقد رفض الحكم هذا المنطق. فالتكنولوجيا قد تساعد الإدارة، لكنها لا تستطيع أن تحل محل التقييم القانوني الذي يفرضه التشريع.
لا يجوز تحميل العامل مسؤولية كل خلل تقني
تناول الحكم أيضاً مسألة جوهرية تتعلق بالمسؤولية.
فعملية إرسال عقد الإقامة إلكترونياً يتولاها عادة صاحب العمل أو وسيط يعمل نيابة عنه. وغالباً لا يملك العامل الأجنبي أي سيطرة مباشرة على هذه المرحلة.
ولذلك لا يكون من المعقول تحميله تلقائياً نتائج خطأ ارتكبه صاحب العمل أو مستشار أو منظمة مهنية أو حتى المنصة الرقمية نفسها.
ويتعيّن على الإدارة فحص الظروف الواقعية لكل حالة.
وعليها التحقق مما إذا كان العامل قد وقّع العقد داخل المهلة، وأبلغ صاحب العمل بوصوله، وقَبِل الوظيفة، وتعاون بصورة صحيحة مع الإجراء.
فإذا ثبت أنه أدى ما عليه، فلا ينبغي أن يؤدي غياب الوثيقة من النظام الإلكتروني بصورة آلية إلى ضياع كامل الإجراء المتعلق بالهجرة.
الوظيفة كانت حقيقية وليست صورية
تكتسب القضية أهمية خاصة لأن علاقة العمل كانت قد بدأت فعلياً.
فلم تكن المسألة تتعلق بصاحب عمل وهمي، أو عرض عمل مزور، أو علاقة عمل غير موجودة.
دخل العامل إيطاليا بتأشيرة صحيحة، ووقّع عقد الإقامة، وبدأ العمل وفقاً للترخيص الممنوح.
وكانت المشكلة الوحيدة تتعلق بإرسال الوثيقة.
وكان من شأن الإغلاق النهائي للإجراء في مثل هذه الظروف أن يؤدي إلى نتيجة تتعارض مع الغاية من نظام الحصص: حرمان عامل دخل بصورة قانونية وبدأ العمل فعلياً من الحصول على تصريح الإقامة بسبب خلل إداري قابل للتدارك.
على الإدارة إعادة فتح الإجراء
لم يمنح الحكم تصريح الإقامة بصورة تلقائية.
بل ألزم المكتب الموحد للهجرة بإعادة فتح الملف وممارسة صلاحياته مجدداً وفقاً للمبادئ التي حددتها المحكمة.
ويجب على الإدارة أن تمنح الطرفين مهلة واضحة لتقديم عقد موقّع بصورة صحيحة، ثم تُكمل الإجراء إذا كانت جميع الشروط القانونية متوافرة.
وهكذا أبقت المحكمة على سلطة الإدارة في إجراء الفحوص الضرورية.
أما ما رفضته فهو الأرشفة التلقائية للملف من دون إخطار مسبق، ومن دون التحقق مما إذا كان التأخير منسوباً فعلاً إلى العامل.
تحذير أوسع للنظام الإيطالي
يؤكد الحكم توجهاً سبق أن تبنته المحكمة نفسها في أحكام أخرى صدرت خلال عام 2026.
والرسالة الموجهة إلى مكاتب الهجرة واضحة: لا يجوز إغلاق الإجراءات تلقائياً عندما يمنح القانون العامل صراحة حق إثبات أن التأخير لم يكن راجعاً إليه.
كما يكشف الحكم مشكلة أوسع في الإدارة الإيطالية للهجرة.
فالرقمنة قد تسرّع الإجراءات، لكنها قد تُنتج أيضاً قرارات جامدة وغير عادلة عندما لا تتضمن الأنظمة ضمانات إجرائية كافية.
والحل لا يتمثل في تقليص الحقوق لتتناسب مع حدود البرنامج الإلكتروني، بل في تعديل الأنظمة الرقمية لكي تتوافق مع القانون.
وبالنسبة إلى العمال الأجانب، يؤكد الحكم مبدأً أساسياً: لا يجوز لخطأ تقني أن يُسقط إجراءً صحيحاً للعمل والإقامة من دون منح الشخص المعني فرصة حقيقية لشرح ما حدث.
