New on TikTok: Episodio 8 – I found a new job while my renewal was pending: informing the Immigration Office Welcome to a new episode of the Immigration Law Podcast. I am lawyer Fabio Loscerbo. Today we are discussing a very common situation. An application to renew a residence permit was submitted several months ago. At that time, the applicant's employment situation was not particularly favourable. During the waiting period, however, a new employment contract was obtained. That contract should not remain in a drawer. Italian immigration law contains an important principle. Under certain conditions, a decision concerning a residence permit must also take into account relevant events that occurred after the application was submitted. Article 5 of Legislative Decree number 286 of 1998 gives relevance to subsequent circumstances that may allow the residence permit to be issued or renewed. This principle has very practical consequences. A person may have submitted an application while unemployed and subsequently found a job. A short-term contract may have been followed by more stable employment. New payslips may have been received, or the applicant's overall financial situation may have improved. These developments may affect the Administration's final assessment. For this reason, it is wrong to assume that after submitting the application there is nothing left to do except wait. The administrative procedure should be followed actively. When favourable new circumstances arise, they should be communicated to the Immigration Office and properly documented. This becomes even more important when the applicant has received a preliminary notice of refusal based precisely on unemployment or insufficient income. The situation that existed several months earlier is not necessarily the situation on which the final decision must be based. The practical rule is simple: while waiting for a renewal, any significant improvement in your employment or financial situation should be assessed and, when relevant, promptly communicated to the authorities. I am lawyer Fabio Loscerbo, and this is the Immigration Law Podcast. See you in the next episode.
